If these Terms of Use or your authorization to access or use the Website, in whole or in part, are terminated for any reason, these Terms of Use and any other agreement then existing between you and Plomberie Jean Lépine shall continue to apply and bind you regarding your prior access and use of the Website and any related matters.

15. APPLICABLE LAW AND DISPUTE RESOLUTION

These Terms of Use, your access to and use of the Website, and any related matters are governed by the laws of British Columbia, Canada, and the federal laws of Canada (and in the case of use of the Website in Quebec by Quebec residents, by the laws of Quebec and the applicable federal laws of Canada).

Any dispute between you and Plomberie Jean Lépine or any other person, arising from or relating to the Website, these Terms of Use, or any related matter (collectively, “Disputes”), shall be resolved before the courts of Quebec, sitting in the city of Longueuil, Quebec, Canada (and in the case of use of the Website in Quebec by residents outside Quebec, the dispute shall also be resolved before the courts of Quebec), and you irrevocably submit to the exclusive jurisdiction of these courts for all Disputes.

 

 

16. RETURNS

Eligible purchases may be returned or exchanged within 30 days* of the purchase date upon presentation of proof of purchase. Returns can only be made in person at the store. The buyer may return any item stocked by Plomberie Jean Lépine that is not a special order if:
(i) it is in new condition, suitable for resale, in its original packaging, intact, and with all original parts;
(ii) it has not been used, installed, modified, rebuilt, repaired, altered, or damaged.

All returns are subject to a 25% restocking fee unless otherwise agreed by Plomberie Jean Lépine. Special orders and non-stocked items may be returned if the manufacturer or supplier accepts the return. Please refer to Plomberie Jean Lépine’s sales policies.

 

 

17. SET-OFF

The buyer may not set off any amounts owed to them by Plomberie Jean Lépine against amounts owed by the buyer to Plomberie Jean Lépine under any transaction governed by these terms of sale.

 

 

18. WARRANTY DISCLAIMER AND LIMITATION OF LIABILITY

Plomberie Jean Lépine only guarantees title to the goods sold, supplied, or delivered to the buyer. All other warranties are those provided by the relevant manufacturer. Links to the warranties of the manufacturers we represent are available on our website. If a product is defective, the legal warranty of the supplier applies, if applicable. Plomberie Jean Lépine assigns to the buyer any warranty provided by its suppliers and the manufacturer.

The buyer waives any right of action against Plomberie Jean Lépine for damages caused by goods sold, supplied, or delivered by Plomberie Jean Lépine, including, without limitation, environmental damage. Any warranty is void in cases of misuse, accident, modification, inappropriate physical environment or operation, improper maintenance, storage, or installation.

The buyer’s sole remedy against Plomberie Jean Lépine shall be repair of the sold product, replacement, or refund of the purchase price paid for products returned during the manufacturer’s warranty period. Plomberie Jean Lépine DISCLAIMS ALL OTHER EXPRESS OR IMPLIED WARRANTIES, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. UNDER NO CIRCUMSTANCES SHALL PLOMBERIE JEAN LÉPINE BE LIABLE FOR SPECIAL, INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES SUFFERED BY THE BUYER, AND IN NO EVENT SHALL PLOMBERIE JEAN LÉPINE’S LIABILITY EXCEED THE NET SALE PRICE OF THE GOODS SOLD, SUPPLIED, OR DELIVERED TO THE BUYER.
